The City of Hamilton, through the Municipal Act currently regulates tree cutting on private property through a number of local municipal by-laws (Ancaster, Stoney Creek, Dundas, and Region of Hamilton-Wentworth).
In May 2005, City staff released a draft tree cutting by-law for public review which regulates trees growing on private property in Hamilton. This draft by-law was revised, based on the comments received. In June 2008, a report went to City Council which presented the revised draft tree cutting by-law. In addition, draft tree protection guidelines were prepared for trees growing on sites proposed for land use changes (i.e. Official Plan and Zoning By-law Amendments, plans of subdivision and condominium, variances, and severances).
City of Hamilton Council directed staff to begin a public consultation process for the proposed new tree cutting by-law for trees growing on private property. Four Public Open Houses were held in the fall of 2008 to receive public and agency input on the draft By-law.
