Chedoke Brow Lands - Secondary Plan

Further to the Public Meeting of the Economic Development and Planning Committee for the Chedoke Brow Lands on June 10th, 2010, the applications were considered by Economic Development and Planning Committee on September 21, 2010.

On September 29th, 2010, Council refused the applications to amend the Hamilton Official Plan,Hamilton Zoning By-law No. 6593, Hamilton Zoning By-law 05-200 and a Plan of Subdivision by Deanlee Management Inc. for the Brow Lands located Part of Lot 57, COncession 2, City of Hamilton (File No. OPA-07-014, ZAC-07-053 and 25T-200712) when they confirmed the recommendation to deny the application made by the Economic Development and Planning Committee on September 21st, 2010.

Please note that on July 8, 2010, an appeal to the Ontario Municipal Board was received from Deanlee Management Inc. on the basis of Council’s refusal or neglect to make a decision on the applications. In accordance with Section 51 (34), Section 17(4) and 34 (11) of the Planning Act, an application may be appealed to the Ontario Municipal Board after 180 days (Subdivision), or 120 days (Official Plan Amendment/Zoning By-law Amendment), if Council has not made a decision on the application(s). Modified Secondary Planning Public Consultation Process
The process is now complete and a community option has been chosen. This option will be incorporated into the staff report to Economic Development and Planning Committee and will reflect the community’s position regarding the redevelopment of the brow lands.

Proposal:
Based on past meetings held by the developer, the lands are proposed to be developed for medium to high density residential purposes. City staff wish to advise that formal applications for amendments to the Official Plan and Zoning By-law have been received. The following studies have been submitted in support of the applications:

Process:
The City of Hamilton is leading a modified secondary planning public consultation process. The consultation process will include 4 meetings open to the public with the goal of determining the community’s preferred development option for the subject area. This community option would then be considered in the evaluation of the development applications for the subject area.

Chedmac Secondary Plan
The lands to the south of the brow lands are subject to the Chedmac Secondary Plan. A copy of the Chedmac Secondary Plan is available for public viewing during regular business hours at the City of Hamilton, City Hall, 6th Floor.
