Hamilton’s Planning and Development Department has received an application to amend the Flamborough Official Plan and Zoning By-law through a redesignation from “Rural” to “Extractive Industrial” and a change in zoning from “A” Agricultural and “CM” Conservation Management to “EI” Extractive Industrial to permit a stone quarry. St Marys Cement has submitted a Draft Haul Route Study to members of CART for review. The documents from this Haul Route Study are attached below. Peer reviews were completed of the Haul Route Evaluation and Transportation Reports, the Natural Environment Report, and the Noise and Vibration Reports. Based on the peer reviews and review of additional material within the Study, the City of Hamilton sent this letter to St Marys Cement outlining concerns with the Haul Route Study.

Notice of St. Marys application under the Aggregate Resources Act (ARA) was published on Friday April 3, 2009. The Notice provides details on the application and the process for filing an objection to the application. The last day of the 45 day commenting period under the ARA is May 21, 2009. Any person(s) wishing to object to the application must do so by May 21, 2009. Information on how to object to the application is provided in the Notice.

St. Marys Cement has submitted an application to the Ministry of Natural Resources (MNR) for a Category 2 (Quarry Below Water) Class “A” Quarry License under the Aggregate Resources Act (ARA). The MNR deemed the application by St. Marys complete on March 3, 2009, as indicated in this letter from the MNR to St. Marys.
The Aggregate Resources Act (ARA) outlines a process for review of an application for a License under the ARA. The process is summarized in this flow chart from the ARA.
Included in this process is an initial 45 day notification and consultation period which is deemed to begin on the date St. Marys publishes a Notice of Application in the local newspaper. Any objections to the proposed License must be made within this 45 day period. Also within this 45 day period, St. Marys must hold one Public Information Session to provide details on the proposal to members of the public.

St. Marys submitted applications for an Official Plan Amendment (OPA-08-014) and Zoning By-law Amendment (ZAC-08-067) on October 22, 2008 related to a 4.2 hectare (10.6 acre) parcel of land located at 1869 Miburough Line (see Location Map) located immediately adjacent to the lands subject to the Flamborough Quarry applications. The intent is to permit these lands to be used for an internal driveway and acoustical barriers associated with the proposed quarry. The planning applications were deemed complete on November 20, 2008. Staff intend to process these applications concurrently with the Flamborough Quarry planning applications submitted in 2004.
