Prepare a sketch of the proposed patio in accordance to SK-1 and SK-2 (PDF, 157 KB) or Pedestrian Bypass SK-3 (PDF, 106 KB). All on-street patios shall have a minimum of 4.5 metres clearance between the street centreline (on a street with a single lane in each direction) and the edge of the patio, if adjacent to a marked bike lane, the traffic clearance will be 0.25 metres from the edge of the bike lane.

I, the aforementioned applicant, have read the On-Street Patios Brochure and understand and agree to the requirements for the installation, maintenance and operation of an On-Street Patio.

Furthermore I am aware that:

  • As the patio owner I am responsible for any issues caused by the placement of this patio over a City of Hamilton catch basin; and
  • The City of Hamilton, at any time, may require me or act itself to remove all or part of the patio, at my expense,
  • I am applying for a (1) year Road Occupancy Permit for a seasonal On-Street patio and that there is no guarantee if I receive a permit this year that I will receive a permit in subsequent years.

Notice of Collection: The City of Hamilton collects information under authority of section 227 of the Municipal Act, 2001. Personal information on this application form is collected for the purposes of administration, management and enforcement of the City's permits and applications related to Outdoor Dining Districts. Personal information along with other information provided with this application will be shared among authorized City staff for the purposes of administering and managing approvals and permits required for the special Outdoor Dining District. Applicants may be contacted by the City or a City-contracted third party for the express purposes of gathering information about the Outdoor Dining District and/or obtaining feedback on the services related to special Outdoor Dining Districts.
